Syracuse man sentenced to prison for stealing guns and reselling them for drugs
Syracuse, NY - A Syracuse man who stole a cache of guns from his parents' Spafford home and resold them for drugs was sentenced today to six years in state prison.
Hayden Marshall, 21, of West Belden Avenue, had nothing to say before state Supreme Court Justice John Brunetti imposed the sentence agreed to when Marshall pleaded guilty last month to second-degree criminal possession of a weapon, third-degree criminal sale of a firearm and fourth-degree grand larceny.
Marshall also pleaded guilty to an unrelated charge of second-degree forgery involving the use of a credit card he stole during a Sept. 27 burglary at the headquarters of the Central New York chapter of the Alzheimer's Association.
For that, he received a sentence of one to three years in prison to be served at the same time as the six-year sentence for the gun case.

Assistant District Attorney Kerry Buske repeated for the record in court today her position that the prosecution wanted Marshall to serve eight years for the gun case plus a consecutive penalty of up to three years for the burglary case.
She noted that while Marshall did not use the guns, he exposed the community to great danger by introducing them into an illegal chain of commerce by trading them for drugs. The possibility the guns might be used in other crimes was a reasonably foreseeable consequence, Buske said.
Authorities contended Marshall stole 16 guns - eight handguns, three shotguns, four rifles and a black-powder gun - from a gun locker in his parents' Spafford home. The prosecution had contended the theft occurred sometime in early June 2010, but Marshall told the court in pleading guilty that he stole the weapons in March 2010 and sold them the following month.
A second defendant, Al Smith, 25, of Avery Avenue, is awaiting sentencing for buying some of the stolen weapons from Marshall and reselling them.
He's to be sentenced by Brunetti to one year in the Onondaga County Correctional Facility. The prosecution wanted a five-year state prison sentence for him.
So, let me try and figure this out. He steals 16 guns, 8 of which are handguns, trades them to drug dealers and gang bangers and gets 6 years?? No wonder why the gangbangers and vermin in the city have no fear of carrying illegal guns. Should have given him a minimum of 2 years per handgun and then charge him as an accessory after the fact for every single crime that the stolen guns can be implicated in. Pathetic sentence...
