That’s probably not quite the message the Supreme Court intended to send Monday in overturning a California law that banned the sale of violent video games to children under 18 unless they had parental consent. But it’s consistent with rulings over the years that material depicting even extreme carnage is, unlike pornography, fully protected by the First Amendment.

In the majority opinion of the 7-2 decision, Justice Antonin Scalia called the California law an “unprecedented” restriction of free speech aimed at children. He said there is no “long-standing tradition in this country of specially restricting children’s access to depictions of violence.” In fact, he pointed out, violence has a long history in children’s literature, from the incineration of the witch in Hansel and Gretel to the blinding of a Cyclops in The Odyssey .

The consensus cut across the court’s liberal and conservative divide, with Justices Anthony Kennedy, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan siding with Scalia. Chief Justice John Roberts and Justice Samuel Alito said an acceptable law might be possible to tailor if it more narrowly defined what was too gruesome for kids.

Justice Stephen Breyer raised the porn/violence dichotomy in his dissent, noting that there is also plenty of material of a sexual nature to which young people are exposed — from the sexuality of Ovid to the nudity of Lady Godiva.

“What sense does it make to forbid selling to a 13-year-old boy a magazine with an image of a nude woman, while protecting a sale to that 13-year-old of an interactive video game in which he actively, but virtually, binds and gags the woman, then tortures and kills her?” he asked. “What kind of First Amendment would permit the government to protect children by restricting sales of that extremely violent video game only when the woman—bound, gagged, tortured, and killed—is also topless? “

He said there is a difference between laws that impose morality on children and those that further the role of parents in teaching their children the values they favor.

Justice Clarence Thomas took a different tack in a separate dissent, casting it as a parental consent issue protected by the Constitution.

The majority noted that the issue of protecting children from perceived harmful effects of certain kinds of media have been going on for years, back at least to the dime-store novels of the 1800s. It certainly has been a debate in the video age. Ronald Reagan once sang the praises of video games as good military training, musing in 1983, “Many young people have developed incredible hand, eye, and brain coordination in playing these games. The Air Force believes these kids will be our outstanding pilots should they fly our jets.” Or, for that matter, our drones.
